To The Stars (TTS) - Review Collection & Compliance Policy

1. Introduction and Purpose

To The Stars ("TTS," "we," "us") provides businesses ("Client," "you") with a platform ("Platform") to facilitate the collection of customer feedback and public reviews.

The purpose of this Review Collection & Compliance Policy ("Policy") is to ensure that all review collection activities conducted through the TTS Platform are transparent, ethical, and ensure you know your responsibility to collect data and feedback through the proper channels.

2. Client Obligations

As a condition of using the TTS Platform, the Client shall:

Maintain Link Integrity

Maintain active and functional links for both the public review page and the private feedback form. The Client shall not disable, hide, obscure, or misrepresent these links.

Prohibition of Manipulation

Refrain from any action intended to discourage or manipulate customer feedback. This includes, but is not limited to:

  • Offering incentives, compensation, or rewards in exchange for positive reviews.
  • Using misleading language that implies negative feedback should only be shared privately.
  • Restrict the user's ability to leave negative feedback on a public platform such as Google by hiding or removing a link to their public review page.

Feedback Form Content

Be solely responsible for the content of their private feedback form (e.g., Google Form, survey). The form must be professional, unbiased, and compliant with all applicable laws.

Google Reviews Link Requirement

If the Client creates their own feedback form (e.g., Google Form), the Client is required to include a direct link to their Google Reviews page at the bottom of the form. This link must be clearly visible, functional, and accessible to all customers who fill out the form. Failure to include the Google Reviews link on a custom form is a violation of these Terms and may result in account suspension.

TTS Form Page - Google Reviews Integration

The official To The Stars Ratings form page includes a Google Reviews link that is permanently locked and prominently displayed. This link cannot be removed, hidden, or modified by the Client. This ensures that all customers always have the option to leave a public Google review, maintaining full transparency and compliance with review collection best practices.

3. TTS Obligations

TTS shall:

Provide Tools

Furnish the Platform in a manner that facilitates compliance with this Policy.

Periodic Auditing

Reserve the right to conduct periodic, unannounced audits of Client feedback pages to ensure ongoing compliance.

Enforcement

In the event of a suspected violation, provide the Client with a notice of the violation. TTS reserves the right to immediately suspend service for flagrant or repeated violations.

4. Prohibited Activities

Clients are expressly prohibited from using the TTS Platform to:

  • Suppress or discourage negative reviews.
  • Hiding or implicitly removing their review link if customer implies that they had a negative experience.
  • Misrepresent the source or authenticity of any review.
  • Violate the terms of service of any third-party review platform.

5. Results & Analytics Disclosure

By using the TTS Platform, the Client agrees that TTS may:

Showcase Results

Use aggregated review improvement data, analytics, and success metrics on our public Results page and marketing materials to demonstrate the effectiveness of our platform.

Business Recognition

Feature the Client's business name, industry, and review improvement statistics as a success story, unless the Client explicitly opts out in writing.

Analytics Usage

Collect and analyze review collection performance data to improve our services and provide benchmark comparisons. All data used publicly will be anonymized unless explicit permission is granted.

Logo Usage

Display the Client's business logo exclusively on the TTS Results page to identify the business alongside their success metrics. Logo usage is strictly limited to the Results page and will not be used for any other purpose or in any other location without the Client's explicit written consent.

6. Payment Terms & Refund Policy

By subscribing to or purchasing any TTS services, the Client agrees to the following payment terms:

Subscription & Billing

All subscription fees are billed in advance on a recurring basis according to the billing cycle selected at purchase. The Client authorizes TTS to charge the payment method on file for all applicable fees. Subscription fees are non-prorated and will be charged in full for each billing period.

No Refunds Policy

All payments made to TTS are final and non-refundable. TTS does not provide refunds or credits for any partial subscription periods, unused services, or dissatisfaction with the Platform. By completing a purchase, the Client acknowledges and accepts this no-refund policy.

Cancellation

The Client may cancel their subscription at any time. Upon cancellation, the Client will retain access to the Platform until the end of the current billing period. No refunds will be issued for the remaining time in the billing cycle.

Failed Payments

If a payment fails, TTS reserves the right to suspend or terminate access to the Platform until payment is successfully processed. The Client is responsible for ensuring their payment information is current and accurate.

7. Limitation of Liability & Disclaimer

The Client acknowledges and agrees to the following limitations:

Client Responsibility

The Client is solely responsible for their use of the TTS Platform and for ensuring compliance with all applicable laws, regulations, and third-party terms of service (including but not limited to Google, Yelp, and other review platforms). TTS is not responsible for any violations committed by the Client or their customers.

No Liability for Violations

TTS shall not be held liable for any damages, losses, penalties, or legal consequences arising from the Client's misuse of the Platform, failure to comply with this Policy, or violation of any third-party terms of service. The Client agrees to indemnify and hold TTS harmless from any claims resulting from the Client's actions.

Service Availability

TTS provides the Platform on an "as-is" and "as-available" basis. TTS makes no warranties, express or implied, regarding the Platform's availability, reliability, or fitness for a particular purpose. TTS is not liable for any downtime, service interruptions, or technical issues.

No Guarantee of Results

TTS does not guarantee any specific results, including but not limited to increased reviews, improved ratings, or business growth. Results vary based on numerous factors outside of TTS's control.

8. Acceptance of Terms & User Agreement

By using the TTS Platform, the Client expressly agrees to the following:

Binding Agreement

By accessing, registering for, or using the TTS Platform in any way, the Client acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions in their entirety. This agreement is legally binding upon the Client.

Full Compliance Required

The Client agrees to comply with all terms, conditions, policies, and guidelines set forth in this document. Failure to comply with any provision may result in immediate suspension or termination of service without refund.

Ethical Use

The Client commits to using the TTS Platform ethically, honestly, and in good faith. The Client shall not engage in any deceptive, fraudulent, or misleading practices while using the Platform.

Updates to Terms

TTS reserves the right to modify these Terms & Conditions at any time. Continued use of the Platform after any changes constitutes acceptance of the updated terms. It is the Client's responsibility to review these terms periodically.

9. AI Features & Acceptable Use Policy

TTS may provide AI-powered features and tools as part of the Platform. By using any AI features, the Client agrees to the following:

Permitted Use

AI features are provided solely for legitimate business purposes related to reputation management, customer feedback analysis, and review collection. The Client shall use AI features only as intended and in accordance with these Terms.

Prohibited AI Use

The Client is strictly prohibited from using TTS AI features for any purpose that TTS, in its sole discretion, deems to be harmful, unethical, illegal, or contrary to the intended use of the Platform. Prohibited uses include, but are not limited to:

  • Generating fake, fabricated, or misleading reviews or feedback.
  • Automating spam, harassment, or abusive communications.
  • Attempting to manipulate, deceive, or mislead customers or third parties.
  • Using AI outputs to violate any law, regulation, or third-party rights.
  • Reverse engineering, extracting, or repurposing AI models or outputs for unauthorized commercial use.
  • Using AI features to generate content that is defamatory, discriminatory, hateful, or threatening.
  • Any other use that TTS determines, at its sole discretion, to be inappropriate or harmful.

Account Suspension & Banning

If TTS determines, in its sole discretion, that the Client has used AI features (or any other Platform features) for any purpose deemed harmful, inappropriate, or in violation of these Terms, TTS reserves the right to immediately suspend or permanently ban the Client's account without prior notice. No refund will be issued for suspended or banned accounts. The Client must contact TTS directly to discuss the suspension or ban and any potential reinstatement of their account.

AI Monitoring & Review

TTS reserves the right to monitor, review, and audit the Client's use of AI features at any time. TTS may implement automated or manual review processes to detect misuse. The Client consents to such monitoring as a condition of using AI features.

10. Privacy & Data Collection

The Client acknowledges and agrees to the following regarding data collection and privacy:

Data We Collect

TTS collects and stores information necessary to provide the Platform, including but not limited to: business name, contact information, email addresses, payment information (processed securely through Stripe), registration codes, usage data, analytics, and customer feedback data submitted through the Platform.

Data Security

TTS implements reasonable security measures to protect Client data. However, TTS cannot guarantee absolute security and shall not be liable for any unauthorized access, data breach, or data loss beyond its reasonable control. The Client acknowledges that no internet-based service can be 100% secure.

Third-Party Sharing

TTS does not sell Client data to third parties. TTS may share data with trusted service providers (such as Stripe for payment processing and Google for email delivery) as necessary to operate the Platform. TTS may also disclose data if required by law or to protect TTS's legal rights.

Cookies & Tracking

TTS uses cookies, tracking pixels (including Meta Pixel), and similar technologies to analyze website traffic, improve user experience, and support advertising efforts. By using the Platform, the Client consents to the use of these technologies.

11. Intellectual Property

The Client acknowledges the following regarding intellectual property:

TTS Ownership

All content, software, designs, branding, trademarks, logos, and technology comprising the TTS Platform are the exclusive property of To The Stars Ratings. The Client is granted a limited, non-exclusive, non-transferable license to use the Platform solely for its intended purpose during the active subscription period.

Restrictions

The Client shall not copy, reproduce, distribute, modify, reverse engineer, decompile, or create derivative works of any part of the TTS Platform without prior written consent from TTS. Unauthorized use of TTS intellectual property may result in account termination and legal action.

12. Account Termination & Suspension

TTS reserves the right to suspend or terminate any Client account under the following circumstances:

Grounds for Suspension or Termination

  • Violation of any provision of these Terms & Conditions.
  • Misuse of AI features or any Platform tools as determined by TTS.
  • Engaging in fraudulent, deceptive, or illegal activity.
  • Non-payment or repeated failed payment attempts.
  • Behavior that TTS, in its sole discretion, deems harmful to TTS, its users, or third parties.
  • Any activity that compromises the security or integrity of the Platform.

Immediate Action

TTS may suspend or ban accounts immediately and without prior notice for serious violations. No refund will be issued for any remaining subscription period on a suspended or terminated account.

Reinstatement Process

If the Client's account is suspended or banned, the Client must contact TTS directly at tothestarsratingsoffical@gmail.com to discuss the issue and any potential reinstatement. Reinstatement is not guaranteed and is entirely at the discretion of TTS.

13. Indemnification

The Client agrees to indemnify, defend, and hold harmless To The Stars Ratings, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) the Client's use or misuse of the Platform; (b) the Client's violation of these Terms; (c) the Client's violation of any law, regulation, or third-party rights; (d) any content or data the Client submits, posts, or transmits through the Platform; or (e) the Client's negligent or willful misconduct.

14. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms shall be resolved as follows:

Informal Resolution

The parties agree to first attempt to resolve any dispute informally by contacting TTS at tothestarsratingsoffical@gmail.com. The parties shall make a good faith effort to resolve the dispute within thirty (30) days before pursuing formal legal remedies.

Limitation on Claims

Any cause of action or claim arising out of or related to use of the Platform must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

15. Entire Agreement & Severability

Entire Agreement

These Terms & Conditions constitute the entire agreement between the Client and TTS regarding the use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

No Waiver

The failure of TTS to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision shall be effective only if in writing and signed by TTS.
